Terms of Service
Effective Date: January 1, 2025
Please read these Terms of Service carefully before using Tubeist. By downloading, installing, or using the application you agree to be bound by these terms. If you do not agree, do not use the app.
1. About Tubeist
Tubeist is an iPhone application for live streaming, leveraging the fMP4 format over the HTTP Live Streaming (HLS) protocol. It is developed and maintained by Subside Technologies and is available on the Apple App Store. The app is designed to facilitate high-fidelity HDR streaming to platforms such as YouTube and Twitch via an HLS relay server.
Tubeist is under active development. New features are added regularly, and behaviour may change between releases.
2. Eligibility
You must be at least 13 years of age to use Tubeist. By using the app you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these terms on your behalf.
3. License to Use
Subject to your compliance with these terms, Subside Technologies grants you a limited, non-exclusive, non-transferable, revocable licence to install and use Tubeist on Apple devices that you own or control, solely for your personal, non-commercial purposes.
This licence does not include the right to sublicence, sell, resell, transfer, assign, or otherwise commercially exploit the application or any portion of it.
4. Acceptable Use
You agree to use Tubeist only for lawful purposes and in accordance with these terms. You must not use the app to:
- Stream, upload, or transmit content that is illegal, defamatory, obscene, harassing, or otherwise objectionable.
- Infringe the intellectual property rights of any third party, including broadcasting copyrighted content without appropriate authorisation.
- Violate the terms of service of any streaming platform you connect to, including but not limited to YouTube and Twitch.
- Attempt to reverse-engineer, decompile, or otherwise derive source code from any compiled part of the application (beyond what is already publicly available under the MIT licence).
- Interfere with or disrupt the security or integrity of any servers or networks connected through the app.
You are solely responsible for all content you choose to stream using Tubeist.
5. In-App Purchases
Tubeist offers optional In-App Purchases (IAPs) to unlock additional visual styles and effects. All purchases are processed by Apple through the App Store and are subject to Apple's payment terms and refund policy.
- IAP prices are set at the lowest available tier on the App Store.
- Purchases are tied to your Apple ID and are non-transferable.
- Where supported by Apple, previously purchased items may be restored via the in-app restore function at no additional charge.
- Subside Technologies does not process or store any payment information.
6. Third-Party Services
Tubeist is designed to interoperate with third-party streaming platforms and overlay services. Use of these services is entirely at your own discretion and subject to their respective terms and privacy policies.
- Streaming Platforms (e.g., YouTube, Twitch): You are responsible for complying with their terms of service, community guidelines, and any applicable content policies when streaming through Tubeist.
- Web Overlay Providers: If you configure web overlays within the app, the data those overlays load is governed by the terms of the respective overlay provider.
- Google / YouTube API: Tubeist may request access to your YouTube account to manage live broadcasts on your behalf. This access is used solely to start, configure, and stop streams from your device. We do not sell or share your account data.
7. HLS Relay Infrastructure
Tubeist transmits your stream to an HLS relay server, which is responsible for forwarding data to your chosen streaming platform. You have two options:
- Self-hosted relay: You operate your own instance of an HLS relay (such as the open-source hls-relay project). You are solely responsible for the security, availability, and compliance of that infrastructure.
- Third-party relay: You connect to a relay service operated by a third party. You are responsible for reviewing and accepting that service's terms of use and privacy policy.
Subside Technologies does not operate a public relay service and accepts no liability for the availability or conduct of any relay infrastructure you choose to use.
8. Open Source
The source code of Tubeist is publicly available on GitHub and is released under the MIT licence. The MIT licence governs your rights to use, copy, modify, and distribute the source code. These Terms of Service govern your use of the compiled application as distributed through the Apple App Store.
9. No Warranty
Tubeist is provided "as is" and "as available", without warranty of any kind. Subside Technologies expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
As an application under active development, Tubeist may contain bugs, experience outages, or behave unexpectedly. We do not warrant that the app will be error-free, uninterrupted, or that any defect will be corrected.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Subside Technologies and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, Tubeist — including but not limited to loss of data, loss of revenue, or reputational damage — even if advised of the possibility of such damages.
In no event shall our total aggregate liability to you exceed the amount you paid, if any, for In-App Purchases during the twelve months preceding the claim.
11. Intellectual Property
The Tubeist name, logo, and all associated branding are the property of Subside Technologies. Nothing in these terms grants you any right to use our trademarks, trade names, or other brand features without prior written permission.
All content you create and stream using Tubeist remains your property, and you retain full responsibility for ensuring you have the rights to stream it.
12. Changes to the App
We reserve the right to modify, suspend, or discontinue Tubeist, or any part of it, at any time and without prior notice. We may release updates that change or remove existing functionality. Continued use of the app following any such changes constitutes your acceptance of the modified app.
13. Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the effective date at the top of this page. For material changes, we will make reasonable efforts to provide notice — for example, through the app or on our website. Your continued use of Tubeist after any changes take effect constitutes your acceptance of the revised terms.
14. Governing Law
These terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Sweden.
If you are a consumer located in the European Union, you may also be entitled to the mandatory consumer protection provisions of your country of residence.
